Representing Elderly Debtors: Practical and Ethical Issues in Bankruptcy Cases

Older adults are filing bankruptcy at significantly higher rates than in previous decades, often due to rising medical costs, fixed incomes, caregiving obligations, mortgage debt, tax issues, and financial exploitation. This program examines the unique legal, practical, and ethical issues that arise when representing elderly debtors in consumer bankruptcy cases. Topics include determining capacity and informed consent, identifying signs of cognitive decline or undue influence, evaluating whether a client is truly collection-proof, protecting Social Security and retirement income, addressing family financial entanglements and exploitation, and analyzing the strategic use of Chapters 7 and 13 for older clients. The presentation will also discuss post-petition issues, including death during the case, hardship discharges, plan modifications, and common ethical concerns that arise when working with aging clients and their families. Practical examples and real-world scenarios will be used throughout the program.

Ashley F. Morgan is the founder of Ashley F. Morgan Law, PC, a consumer bankruptcy and tax resolution law firm based in Northern Virginia. She represents individuals and families in Chapter 7 and Chapter 13 bankruptcy cases, focusing her practice on complex consumer debt issues, tax debt, financial litigation, and long-term financial strategy. Ashley is licensed in Virginia and before the United States Bankruptcy Court for the Eastern District of Virginia, the United States District Court, and the United States Court of Appeals for the Fourth Circuit.
