What is With the Trustees Objecting to Exemptions – EIC/Child Care Credit and/or Prop 209 Exemptions?

ACBC has been monitoring the trustees’ attack on debtor’s using current exemptions. There are two different, but the same, issues. First, objecting to using the Prop 209 exemptions on any debts incurred before December 5, 2022, the effective date of the law. Second, objection to using the Earned Income and Child Care tax credits (that became law in September, 2022), for the reason that ““Prop 209 did not list that exemption, therefore Prop 209 repealed the new tax credit exemptions."

There are more than 60 objections, and more daily. The faculty will discuss the history, and how to deal with these objections. They will also provide copies of their responses to the trustee’s objections, plus exhibits.

Professionally, he is most proud of his awesome staff and his two published appellate wins for consumer debtors: In re. Gray, 523 B.R. 170 (9th Cir. BAP 2014) and In re. Neidorf, 534 B.R. 369 (9th Cir. BAP 2015).

 


 

April Maxwell is the owner of Maxwell Law Group. April has experience in appeals and civil litigation, but bankruptcy has her heart.

April graduated cum laude from the Sandra Day O'Connor School of Law at Arizona State University. During law school, April pursued her interest in science and the law by serving as Associate Editor for Jurimetrics, The Journal of Law, Science, and Technology, the Official Journal for the American Bar Association § of Science & Technology Law. April's interest in law and science earned her the school's Law and Science certificate.

Prior to attending law school, April received her degree in Zoology from Brigham Young University. April is also the proud mother of 4 great kids and makes a mean cinnamon roll.


 Lisa Thompson is licensed to practice law in Arizona, California, Nevada, and Washington, D.C. She graduated from the University of Arizona, College of Law with her Juris Doctor in 1995 and in 1997 with her LL.M. (Master of Laws) in international trade law. Lisa is the author of Arizona Legal Forms – Debtor-Creditor (Second and Third Editions), Arizona Legal Forms – Limited Liability Companies and Partnerships (Third and Fourth Editions) and the Nevada Business Law Deskbook. She is also the co-author of the Arizona Business Law Deskbook series (Volumes 9, 9A, 10 and 10A). Lisa’s Arizona publications are updated annually. She has owned her own law firm since 1997 and focuses her practice on consumer bankruptcy, business reorganization both in and out of bankruptcy and general business and student loan law in the State of Arizona.
