This seminar covers the essentials of adversary proceedings in bankruptcy, including common disputes such as dischargeability, preferences, and fraudulent transfers. Special focus is placed on perfecting (or attacking) an adversary proceeding, understanding how issue and claim preclusion are applied in bankruptcy court, and preserving the record for appeal—making proper objections, ensuring key arguments are preserved, and building a clear evidentiary record to protect issues for appellate review.
